ICAI Notifications relating to removal of name of its members from Register of Members, issued from time to time, debarring them to practise as a Chartered Accountant for a period specified therein.

ICAI Notification dt. 14 Sept. 2016 as published in the Gazette of India on 18 Oct. 2016 (Re. CA Vivek Kapoor, M. No. 082294)

No. 29-CA/LAW/D-305,307,309/2016.—In exercise of the powers conferred by Sub-Section (2) of Section 20 of The Chartered Accountants Act, 1949 read with Regulation 18 of the Chartered Accountants Regulations, 1988, it is hereby notified by the Council of the Institute of Chartered Accountants of India that the Hon’ble High Court of Punjab and Haryana has, in pursuance to Section 21(6)(c) of the said Act, in Chartered Accountant Reference Nos.5 and 6 of 2012 and 1 of 2013, ordered on 18th March, 2016 that the name of Shri Vivek Kapoor, 26, Majitha Road, Amritsar- 143001 (M.No.082294) be removed from the register of members permanently for having been found guilty of “Other Misconduct” falling under Section 22 read with Section 21 of the Chartered Accountants Act, 1949 in all three matters. It is hereby informed that the name of Shri Vivek Kapoor stands removed from register of members w.e.f. 1st October, 2004 due to non payment of fees. Now in terms of the aforesaid order of the Hon’ble High Court of Punjab & Haryana the name of Shri Vivek Kapoor shall stand removed permanently from the register of members from the date of publication of this notification. From now he shall not be entitled to practise as a Chartered Accountant in terms of the said order of the Hon’ble High Court of Punjab and Haryana.

In terms of the provisions of Section 21B(3) of the Chartered Accountants Act, 1949 [as amended by the Chartered Accountants (Amendment) Act, 2006], read with Rules 18(17) and 19(1) of the Chartered Accountants (Procedure of Investigations of Professional and Other Misconduct and Conduct of Cases) Rules, 2007, Shri Mahendra Kumar Hingar (Membership No. 071300), Chartered Accountant, Kayasthwara, Opp. Electric Sub Station, Rewari – 123 401 has been held guilty of Professional Misconduct falling within the meaning of Clause (11) of Part I of the First Schedule and also Clauses (7) and (9) of Part I of Second Schedule to the aforesaid Act by the Disciplinary Committee which ordered for removal of the name of aforesaid Shri Mahendra Kumar Hingar (Membership No.071300) from the Register of Members for a period of one (1) month and also imposed a fine of Rs.10,000/- (Rupees Ten Thousand only) which stands paid. In pursuance thereof and in exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, read with Regulation 18 of the Chartered Accountants Regulations, 1988, it is hereby notified that the name of said Shri Mahendra Kumar Hingar (Membership No. 071300), shall stand removed from the Register of Members for a period of one (1) month with effect from 6th June, 2016.

In terms of the provisions of Section 21B(3) of the Chartered Accountants Act, 1949 [as amended by the Chartered Accountants (Amendment) Act, 2006], read with Rules 18(17) and 19(1) of the Chartered Accountants (Procedure of Investigations of Professional and Other Misconduct and Conduct of Cases) Rules, 2007, Shri D. Sundararajan (Membership No. 010150), Chartered Accountant, D. No. 46/5-A 1, Mariamman Koil New Street, Thirugnanam Nagar No. 1, Dadagapatty, Salem – 636 006 has been held guilty of Professional Misconduct falling within the meaning of Clauses (3) and (7) of Part I and Clause (1) of Part II of Second Schedule to the aforesaid Act by the Disciplinary Committee which ordered for removal of the name of aforesaid Shri D. Sundararajan (Membership No. 010150) from the Register of Members for a period of three (3) years and also imposed a fine of Rs.1,00,000/- (Rupees One lac only) which does not stand paid as on date. In pursuance thereof and in exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, read with Regulation 18 of the Chartered Accountants Regulations, 1988, it is hereby notified that the name of said Shri D. Sundararajan (Membership No. 010150), shall stand removed from the Register of Members for a period of three (3) years with effect from 6th June, 2016.

In terms of the provisions of Section 21B(3) of the Chartered Accountants Act, 1949 [as amended by the Chartered Accountants (Amendment) Act, 2006], read with Rules 18(17) and 19(1) of the Chartered Accountants (Procedure of Investigations of Professional and Other Misconduct and Conduct of Cases) Rules, 2007, Ms. Sunita Shamsunder Narang (Membership No. 046574), Chartered Accountant, 7, Radhamohan, 4 th Floor, 7th Golibar Road, Near Khar Subway, Santacruz (E), Mumbai – 400 055 has been held guilty of Professional Misconduct falling within the meaning of Clauses (7) and (9) of Part I of Second Schedule to the aforesaid Act by the Disciplinary Committee which ordered for removal of the name of aforesaid Ms. Sunita Shamsunder Narang (Membership No.046574) from the Register of Members for a period of three (3) months which shall run concurrently in both the matters mentioned above and also imposed a fine of Rs. 25,000 (Rupees Twenty Five Thousand Only) for each matter separately which stands paid. In pursuance thereof and in exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, read with Regulation 18 of the Chartered Accountants Regulations, 1988, it is hereby notified that the name of said Ms. Sunita Shamsunder Narang (Membership No. 046574), shall stand removed from the Register of Members for a period of three (3) months with effect from 6th June, 2016.

In terms of the provisions of Section 21A(3) of the Chartered Accountants Act, 1949 [as amended by the Chartered Accountants (Amendment) Act, 2006], read with Rules 14(9) and 15(1) of the Chartered Accountants (Procedure of Investigations of Professional and Other Misconduct and Conduct of Cases) Rules, 2007, Shri N. Sundararajan (Membership No. 021341), Chartered Accountant, No. 23, 1st Floor, Dhanvanthri Complex, Dhanvantri Road, Mysuru – 570 001 has been held guilty of ‘Other Misconduct’ falling within the meaning of Clause (2) of Part IV of the First Schedule to the aforesaid Act, by the Board of Discipline which ordered that the name of aforesaid Shri N. Sundararajan (Membership No. 021341), be removed from the Register of Members for a period of one (1) month and further imposed a fine of Rs. 50,000/- (Rupees Fifty Thousand only) upon him which stands paid. In pursuance thereof and in exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, read with Regulation 18 of the Chartered Accountants Regulations, 1988, it is hereby notified that the name of said Shri N. Sundararajan (Membership No. 021341) shall stand removed from the Register of Members for a period of one (1) month with effect from 6th June, 2016.

ICAI Notification dt. 25th April, 2016 as published in the Gazette of India (Re. CA Deepak Mehta, M. No. 074240)

In terms of the provisions of Section 21(3) of the Chartered Accountants Act, 1949 Shri Deepak Mehta, (Membership No. 074240) Chartered Accountant, Shop 23, 3rd D Road, Behind Motor Merchant, Sardarpura, Jodhpur-342 001 has been found guilty, by the Council of the Institute of Chartered Accountants of India, of Professional Misconduct falling within the meaning of Clause (8) of Part I of the First Schedule to the Chartered Accountants Act, 1949 read with Sections 21 and 22 of the said Act. Thereafter, in respect of the aforesaid misconduct, the Council of the Institute, after affording an opportunity of hearing under Section 21(4) of the said Act to the said Shri Deepak Mehta, has ordered that his name be removed from the Register of Members for a period of two (2) years. Shri Deepak Mehta challenged the Order passed by the Council of the Institute by filing S.B. Civil Miscellaneous Appeal no.700/2009 before High Court of Judicature, Rajasthan. The Hon’ble High Court of Rajasthan by its judgement dated 31.01.2011 partly allowed the appeal, by substituting the penalty of removal of name with the penalty of reprimand. Thereafter, the ICAI filed an appeal by way of Special Leave Petition bearing no. 1883 against the Order of Hon’ble High Court of Rajasthan, before the Hon’ble Supreme Court. The Hon’ble Supreme Court vide order dated 13.02.2015, set aside the impugned High Court Order and allowed the appeal, ordering for removal of the name of Shri Deepak Mehta from the Register of Members for a period of three (3) months. In pursuance thereof and in exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, it is hereby notified under Regulation 18 of the Chartered Accountants Regulations, 1988 that the name of said Shri Deepak Mehta (Membership No. 074240) shall stand removed from the Register of Members for a period of three (3) months with effect from 25.04.2016.

In terms of the provisions of Section 21A(3) read with sub-rule (9) of Rule 14 of the Chartered Accountants (Procedure of Investigations of Professional and Other Misconduct and Conduct of Cases) Rules, 2007, Shri Vemuri Rama Chandra Rao (Membership No. 203292) Chartered Accountant, 11-3-370/1, Srinivas Nagar, Flat No. 302, Kamal Tarun Apartments, Near Prasana Venkateswara Swamy Temple, Secunderabad 500 061, has been found guilty of ‘Other Misconduct’ falling within the meaning of Clause (2) of Part IV of the First Schedule to the Chartered Accountants Act, 1949 [as amended by the Chartered Accountants (Amendment) Act, 2006] by the Board of Discipline of the Institute. Thereafter, in terms of provisions of Section 21A(3) read with sub-rule (1) of Rule 15 of the aforesaid Rules, the Board of Discipline, afforded an opportunity of hearing in person to the said Shri Vemuri Rama Chandra Rao. Accordingly, the Board of Discipline has in exercise of the powers conferred by sub-section (3) of Section 21A of the aforesaid Act ordered that the name of aforesaid Shri Vemuri Rama Chandra Rao, be removed from the Register of Members for a period of one (1) month. In pursuance thereof and in exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, it is hereby notified under Regulation 18 of the Chartered Accountants Regulations, 1988 that the name of said Shri Vemuri Rama Chandra Rao (Membership No. 203292) shall stand removed from the Register of Members for a period of one (1) month with effect from 25.04.2016.

In terms of the provisions of Section 21A(3) read with sub-rule (9) of Rule 14 of the Chartered Accountants (Procedure of Investigations of Professional and Other Misconduct and Conduct of Cases) Rules, 2007, Shri Shyam Sunder Mundra (Membership No. 072369) M/s. S.S. Mundra & Associates, Chartered Accountants, 1/10, Mahesh Nagar, Indore – 452 002 has been found guilty of ‘Other Misconduct’ falling within the meaning of Clause (2) of Part IV of the First Schedule to the Chartered Accountants Act, 1949 [as amended by the Chartered Accountants (Amendment) Act, 2006] by the Board of Discipline of the Institute . Thereafter, in terms of provisions of Section 21A(3) read with sub-rule (1) of Rule 15 of the aforesaid Rules, the Board of Discipline, afforded an opportunity of hearing in person to the said Shri Shyam Sunder Mundra. Accordingly, the Board of Discipline has in exercise of the powers conferred by sub-section (3) of Section 21A of the aforesaid Act ordered that the name of aforesaid Shri Shyam Sunder Mundra, be removed from the Register of Members for a period of three (3) months and also imposed a fine of Rs. 10,000/ – (ten thousand only) upon him which stands paid. In pursuance thereof and in exercise of the powers conferred by subsection (2) of Section 20 of the aforesaid Act, it is hereby notified under Regulation 18 of the Chartered Accountants Regulations, 1988 that the name of said Shri Shyam Sunder Mundra (Membership No. 072369) shall stand removed from the Register of Members for a period of three (3) months with effect from 25.04.2016.

In exercise of powers conferred by sub-section 2 of Section 20 of the Chartered Accountants Act, 1949 [as amended by the Chartered Accountants (Amendment) Act, 2006] read with Regulation 18 of the Chartered Accountants Regulations, 1988 it is hereby notified that in pursuance of the Orders passed by the Board of Discipline in Case Nos. DD/98/11/BOD/109/13 & DD/114/09/BOD/58/10 under Section 21A(3) of the said Act, the name of Shri Sitaram Mahabeleshwar Bhat (Membership No. 030696) Chartered Accountant, Block – H, Shri Sadashiv CHS Ltd., 6th Road, Santacruz – East, Mumbai – 400 055, be removed from the Register of Members for a period of three months which shall run concurrently, for having been found guilty of ‘Other Misconduct’ falling within the meaning of Clause (2) of Part IV of the First Schedule of the Chartered Accountants Act, 1949 [as amended by the Chartered Accountants (Amendment) Act, 2006]. Accordingly, it is hereby informed that the name of Shri Sitaram Mahabeleshwar Bhat (Membership No. 030696) shall stand removed from the Register of Members for a period of three (3) months with effect from 25.04.2016.

In exercise of the powers conferred by sub-section (2) of Section 20 of The Chartered Accountants Act, 1949 read with Regulation 18 of the Chartered Accountants Regulations, 1988, it is hereby notified by the Council of the Institute of Chartered Accountants of India that the Hon’ble High Court of Punjab and Haryana has, in pursuance of Section 21(6)(c) of the said Act, in Civil Reference No. 4/2012, ordered on 5th May, 2014 that the name of Shri Subhash Chand Panchal, A 10 First Floor, MGS Chambers, Nehru Ground, NIT, Faridabad- 121001 (M. No. 093533), be removed from the Register of Members for a period of one year for having been found guilty of ‘other misconduct’ falling under Section 22 read with Section 21 of the Chartered Accountants Act, 1949. Accordingly, it is hereby informed that the name of the said Shri Subhash Chand Panchal shall stand removed from the Register of Members for a period of one year w.e.f. 1st April, 2016. During that period he shall not practise as a Chartered Accountant in terms of the said Order of the Hon’ble High Court of Punjab & Haryana.

In exercise of the powers conferred by sub-section (2) of Section 20 of the Chartered Accountants Act, 1949 read with Regulation 18 of the Chartered Accountants Regulations, 1988, it is hereby notified by the Council of the Institute of Chartered Accountants of India that the Hon’ble High Court of Karnataka has, in pursuance of Section 21(6)(c) of the said Act, in Civil Petition No. 191/2012, ordered on 5th March, 2015 that the name of Shri S. Giridharan, Chartered Accountant, 136/1, Ist Floor, Nadi Gruha, 5th Main, Chamarajpet, Bangalore – 560 018 (M.No. 024011) be removed from the Register of Members for a period of one month for having been found guilty of professional misconduct falling within the meaning of Clauses (5), (6), (7), (8) and (9) of Part I of the Second Schedule read with Sections 21 and 22 of the Chartered Accountants Act, 1949. Accordingly, it is hereby informed that the name of the said Shri S. Giridharan shall stand removed from the Register of Members for a period of one month w.e.f. 01.04.2016. During that period he shall not practise as a Chartered Accountant in terms of the said order of the Hon’ble High Court of Karnataka.

In terms of the provisions of Section 21A(3) read with sub-rule (9) of Rule 14 of the Chartered Accountants (Procedure of Investigations of Professional and Other Misconduct and Conduct of Cases) Rules, 2007, Shri Radhey Shyam Jaiswal (Membership No. 070495) Chartered Accountant, CP – 12, Sector – C, Aliganj, Lucknow 226 020 has been found guilty of ‘Other Misconduct’ falling within the meaning of Clause (2) of Part IV of the First Schedule to the Chartered Accountants Act, 1949 [as amended by the Chartered Accountants (Amendment) Act, 2006] by the Board of Discipline of the Institute. Thereafter, in terms of provisions of Section 21A(3) read with sub-rule (1) of Rule 15 of the aforesaid Rules, the Board of Discipline, afforded an opportunity of hearing in person to the said Shri Radhey Shyam Jaiswal. Accordingly, the Board of Discipline has in exercise of the powers conferred by sub-section (3) of Section 21A of the aforesaid Act ordered that the name of aforesaid Shri Radhey Shyam Jaiswal, be removed from the Register of Members for a period of three (3) months and also imposed a fine of Rs. 10,000/- (ten thousand only) upon him which does not stand paid. In pursuance thereof and in exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, it is hereby notified under Regulation 18 of the Chartered Accountants Regulations, 1988 that the name of said Shri Radhey Shyam Jaiswal (Membership No. 070495) shall stand removed from the Register of Members for a period of three (3) months with effect from 07.07.2015.

ICAI Notification dt. 16 Dec., 2014 as published in the Gazette of India on 19 Dec 2014 (Re. CA Ved Prakash Verma, M. No. 009806)

In exercise of the powers conferred by sub-section (2) of Section 20 of The Chartered Accountants Act, 1949 read with Regulation 18 of the Chartered Accountants Regulations, 1988, it is hereby notified by the Council of the Institute of Chartered Accountants of India that the Hon’ble High Court of Delhi has, in pursuance of Section 21(6)(c) of the said Act, in Chartered Accountant Reference Case No. 5/2012, ordered on 2nd September, 2014 that the name of Shri Ved Prakash Verma, 8A, Block A, Express View Apartments, Sector-105, Noida, Gautam Budh Nagar, Uttar Pradesh, 201301 (M. No. 009806), be removed from the Register of Members for a period of six months for having been found guilty of professional misconduct falling within the meaning of Clause (7) of Part I, Clause (i) of Part II of Second Schedule and “Other Misconduct” under Section 22 read with Section 21 of the Chartered Accountants Act, 1949. Accordingly, it is hereby informed that the name of the said Shri Ved Prakash Verma shall stand removed from the Register of Members for a period of six months w.e.f. 1st January, 2015. During that period he shall not practise as a Chartered Accountant in terms of the said order of the Hon’ble High Court of Delhi.

In exercise of the powers conferred by sub-section (2) of Section 20 of The Chartered Accountants Act, 1949 read with Regulation 18 of the Chartered Accountants Regulations, 1988, it is hereby notified by the Council of the Institute of Chartered Accountants of India that the Hon’ble Allahabad High Court has, in pursuance of Section 21(6)(c) of the said Act, in Chartered Accountant Reference Case No. 1/1989, ordered on 22nd August, 2012 that the name of Shri R. L. Narula, FCA, Chartered Accountant, H-76, Kirti Nagar, New Delhi –110 015 (M. No. 010899) be removed from the Register of Members for a period of five days for having been found guilty of professional misconduct within the meaning of Section 21 read with Section 22 of the Chartered Accountants Act, 1949 and Clause (i) of Part II of the Second Schedule to the said Act. Accordingly, it is hereby informed that the name of the said Shri R.L. Narula shall stand removed from the Register of Members for a period of five days w.e.f. 1st July, 2013. During that period he shall not practise as a Chartered Accountant in terms of the said order of the Hon’ble Allahabad High Court.
