Govt notifies “Enemy Property (Amendment and Validation) Act, 2017”

Govt has notified the “Enemy Property (Amendment and Validation) Act, 2017“, an Act further to amend the Enemy Property Act, 1968 (the principal Act) and the Public Premises (Eviction of Unauthorised Occupants) Act, 1971.

Enemy Property (Amendment and Validation) Act, 2017: GOI Notification dt. 14 March 2017 

It may be noted that this Act vests all rights, titles and interests over enemy property with the Custodian and declares transfer of enemy property by the enemy to be void. Besides, it prohibits civil courts and other authorities from entertaining disputes related to enemy property. This Act applies retrospectively in the matter of transfers of enemy property that have occurred before or after 1968.

Basically this Act empowers the Custodian/ Govt. to takeover/ seize the properties left behind by persons (enemy) those who had migrated to Pakistan/ China during or after the wars.
