CBDT/ Income Tax Deptt. has issued Instructions for filing of New ITR Forms (ITR 1 Sahaj, ITR 2, ITR 3, ITR 4 Sugam, ITR 5, ITR 6 and ITR 7) applicable for the FY 2017-18/ AY 2018-19 (download pdf). It may be noted that these instructions are guidelines for filling the particulars in the applicable ITR Form. In case of any doubt, please refer to relevant provisions of the Income-tax Act, 1961 and the Income-tax Rules, 1962.

Instructions for Filing New ITR 1 Sahaj (FY 2017-18/ AY 2018-19):

Form ITR-1 Sahaj is meant for individuals being a resident other than not ordinarily resident having Income from Salaries, one house property, other sources (Interest etc.) and having total income upto Rs.50 lakh.

This Return Form (ITR-1 Sahaj) is to be used by an individual who is a resident other than not ordinarily resident and whose total income for the assessment year 2018-19 includes:-

(a) Income from Salary/ Pension; or

(b) Income from One House Property (excluding cases where there is brought forward loss or loss to be carried forward from previous year); or

(c) Income from Other Sources (excluding winning from lottery and income from Race Horses, Income taxable under section 115BBDA or Income of the nature referred to in section 115BBE).

Further, in a case where the income of another person like spouse, minor child, etc. is to be clubbed with the income of the assessee, this Return Form can be used only if the income being clubbed falls into the above income categories.

This Return Form (ITR-1 Sahaj) should not be used by an individual whose total income for the assessment year 2018-19 exceeds Rs.50 lakh or includes,-

(a) Income from more than one house property and where there is brought forward loss or loss to be carried forward from previous year; or

(b) Income from winnings from lottery or income from Race horses; or

(c) Income taxable under section 115BBDA; or

(d) Income of the nature referred to in section 115BBE; or

(e) Income under the head “Capital Gains” e.g., short-term capital gains or long-term capital gains from sale of house, plot, shares etc.; or

(f) Income to be apportioned in accordance with provisions of Section 5A.

(g) Agricultural income in excess of ₹5,000; or

(h) Income from Business or Profession; or

(i) Loss under the head ‘Income from other sources’; or

(j) Person claiming relief under section 90 and/or 91; or

(k) Any resident having any asset (including financial interest in any entity) located outside India or signing authority in any account located outside India; or

(l) Any resident having income from any source outside India;

m) In case the income is to be apportioned in accordance with provisions of section 5A.

Instructions for Filing New ITR 2 (FY 2017-18/ AY 2018-19):

This Return Form (ITR-2) is to be used by an individual or a Hindu Undivided Family (HUF) who is not eligible to file Sahaj (ITR-1) and who is not having any income under the head “Profits or gains of business or profession”. However, it should not be used by an individual whose total income for the assessment year 2018-19 includes Income under the head “Profits or Gains of Business or Profession”.

Instructions for Filing New ITR 3 (FY 2017-18/ AY 2018-19):

This Return Form (ITR-3) is to be used by an individual or a Hindu Undivided Family who is having income under the head “profits or gains of business or profession” and who is not eligible to file Sugam (ITR-4).

It may be noted that where the books of accounts are required to be audited under section 44AB, the return is required to be furnished the return electronically under digital signature.

Tax-payers are advised to match the taxes deducted/ collected/ paid by or on behalf of them with their Tax Credit Statement (Form 26AS).  In case an assessee is required to furnish a report of audit under sections 10AA, 44AB, 44DA, 50B, 80 -IA, 80-IB, 80-IC, 80-ID, 80JJAA, 80LA, 92E, 115JB or 115JC, he shall file such report electronically on or before the date of filing the return of income.

Instructions for Filing New ITR 4 Sugam (FY 2017-18/ AY 2018-19):

Form ITR-4 Sugam is meant for Presumptive Income from Business & Profession.

This Return Form (ITR-4 Sugam) is to be used by an individual/ HUF/ Partnership Firm whose total income for the assessment year 2018-19 includes:-

(a) Business income where such income is computed in accordance with special provisions referred to in sections 44AD and 44AE of the Act for computation of business income; or

(b) Income from Profession where such income is computed in accordance with special provisions referred to in sections 44ADA; or

(c) Salary/ Pension; or

(d) Income from One House Property (excluding cases where there is brought forward loss or loss to be carried forward under this head); or

(e) Income from Other Sources (excluding Winning from Lottery and Income from Race Horses).

It may be noted that i) The income computed shall be presumed to have been computed after giving full effect to every loss, allowance, depreciation or deduction under the Income-tax Act and ii) in a case where the income of another person like spouse, minor child, etc. is to be clubbed with the income of the assessee, this Return Form can be used only if the income being clubbed falls into the above income categories.

This Return Form (ITR-4 Sugam) is not to be used in the following cases:

(a) Income from more than one house property or where there is brought forward loss or loss to be carried forward under this head; or

(b) Income from Winnings from lottery or income from Race horses; or

(c) Income under the head ―Capital Gains‖, e.g. Short-term capital gains or long-term capital gains from sale of house, plot, shares etc.; or

(d) Income taxable under section 115BBDA; or

(e) Income of the nature referred to in section 115BBE; or

(f) Agricultural income in excess of ₹5,000; or

(g) Income from Speculative Business and other special incomes; or

(h) Income from an agency business or income in the nature of commission or brokerage; or

(i) Person claiming relief of foreign tax paid under section 90, 90A or 91; or

(j) Any resident having any asset (including financial interest in any entity) located outside India or signing authority in any account located outside India; or

(k) Any resident having income from any source outside India.

Further, it may be noted that ITR-4 SUGAM shall ‘not apply’ at the option of the assessee, if:- (i) the assessee keeps and maintains all the books of account and other documents referred to in section 44AA in respect of the business or profession; (ii) the assessee gets his accounts audited and obtains a report of such audit as required under section 44AB in respect of the business or profession. In the above scenarios, regular ITR-3 or ITR-5, may be filed and not the SUGAM.

Instructions for Filing New ITR 5 (FY 2017-18/ AY 2018-19):

This Form (ITR-5) can be used by a person being a firm, LLPs, AOP, BOI, artificial juridical person referred to in section 2(31)(vii), persons referred to in section 160(1)(iii) or (iv), cooperative society, registered societies and local authority. However, a person who is required to file the return of income under section 139(4A) or 139(4B) or 139(4C) or 139(4D) or 139(4F) shall not use this form.

A firm whose accounts are liable to audit under section 44AB shall compulsorily furnish the return electronically under digital signature. In case an assessee who is required to furnish a report of audit under sections 10AA, 44AB, 44DA, 50B, 80-IA, 80-IB, 80-IC, 80-ID, 80JJAA, 80LA, 92E, 115JB or 115JC shall also file the report electronically on or before the date of filing the return of income.

Instructions for Filing New ITR 6 (FY 2017-18/ AY 2018-19):

This Form (ITR-6) can be used by a company, other than a company claiming exemption under section 11.

Instructions for Filing New ITR 7 (FY 2017-18/ AY 2018-19):

This Form (ITR-7) can be used by persons including companies who are required to furnish return under section 139(4A) or section 139(4B) or section 139(4C) or section 139(4D) or section 139(4E) or section 139(4F).
